General conditions of carriage 2024 Håkull AS


1. Transport instructions:

All instructions will be carried out according to “Nordic Freight forwarders Associations General rules” (NSAB 2015 or latest version). The instructions will also be executed according to the CMR convention and according to regulations issued by EU and regulated through the EEA agreement. Further also law dated 20 December 1974 no 68 (incl. later corrections), concerning freight agreements by international conveyance of trailed goods (Norway).Rules and laws connected to cabotage are followed according to actual in activity. The regulations connected to minimum wage connected to road transport (law of 04.06.1993 nr 58) and later corrections (Kap. II § 3), is followed based on actual niveau at the time. Håkull AS has AEO certification.


2. Reservations:

We reserve the rights to adjust our prices without pre-advice if changes occur due to e.g. public duties/taxes/currency/ferry costs/fuel increases etc. Otherwise we refer to NSAB 2015 § 8

It is a prerequisite that goods are properly packed for safe handling and can be secured on a trailer in accordance with the applicable regulations (national and international) and that the goods are clearly labelled. Goods packed in wooden crates etc. must be properly secured in the packaging. (NSAB 2015 § 16 ).

Quoted transport prices are based on normal transit time, outer border customs clearance, and a maximum of 1 hour at the loading or unloading point. Deviations will result in additional charges. Direct collection and delivery is carried out by lorry without a lifting strap. A lorry with a lifting strap can be offered by special agreement/price.

Contractor will be responsible for the freight and the costs connected to EXW shipments in those cases where the transportbuyer/freightresponsible do not pay Håkull AS invoices in due date.

Export and import assignments are carried out by Håkull AS on the assumption, and in the belief, that the documents presented to us are correct for the item(s) in question. This also applies to matters relating to the number of packages, weight, product content, product information, etc. Håkull AS disclaims any financial responsibility for errors and deficiencies due to the fact that we have received incorrect information from one of the parties in the transport chain about such conditions. We will hold the client responsible for all financial consequences that errors and deficiencies have caused Håkull AS or anyone that Håkull AS employs.

Offers that are covered by time guarantee (NSAB 2015 § 7 second paragraph) and storage (NSAB 2015 § 25 point A), must be agreed separately and in writing.

Transit documents (TET) are issued based on customer instructions. The customer will be kept responsible for eventual claims (costs) that could occur, due to that such document(s) are not closed in a legal way and time. This point also includes when issued by Håkull AS’ sub-suppliers.


3. Factor of conversion

1 cbm = Nordic 360kg Continent 333kg
1 loading metre = Nordic 2000 kg Continent 1850 kg
1 EUR pallet = Nordic 800 kg/0.4 ladm Continent 740 kg/0.4 ladm

Cargo with special width: Freight costs must be agreed upon in each case.

Long goods - Calculation form: Length of goods x pallet width (0.8/1.2/1.6) divided by 2.4 metres = number of loading metres. Width over

1.6 m is calculated as the full width (the length is then the number of loading metres)

Return of packing material is not calculated and must be agreed separately and to separate price.


4. Dangerous cargo

Transport by separate agreement and at a separate price. Must be agreed in on a case-by-case basis with regard to hazard classes/ferries.

Shipper must organize proper marking of cargo


5. Shipping calculations/prices

All estimations are made on the principle of optimisation of freight. (Are not valid when offered in other number then per 100 kg)

This does not include consignments under 499 kg. Shipments past 500 kg rounded up to nearest 100 kg.

All prices are given and based on INCOTERMS 2020’s terms of delivery

All order s are conducted according to NSAB 2015

No exchange of pallets is connected to our freight offers.

All prices are based on maximum 1 hours per complete truck on loading and unloading point. When this are exceeded, rate for extra waiting time has to be separately agreed.

Export prices from Norway are given based on custom clearance EU border-crossing if nothing else has been agreed

Road-taxes will be invoiced based on Håkull AS valid terms and prices.

COD shipments are handled on separate terms and conditions.


6. Taxes

Commodity-/ Harbour taxes will be added, according to public regulations in the actual harbours involved, if not other arrangements are agreed.

Other taxes not specific mentioned in the freight contract, will be added separately.


7. Expense commission:

The rates are available on request. Applies, for example, to the payment of import VAT and other amounts paid. Freight and other costs are collected at the same time in such cases.


8. Insurance

The prices quoted do not cover insurance on transported goods. Our liability is limited in accordance with the above.

transport regulations (see section 1). Håkull AS can take out its own transport insurance on

individual basis through our insurance company (CODAN). This must be agreed separately and in writing and in accordance with insurance rules, latest edition.


9. Terms of payment

Net per 10 days, after maturity, 8.5 % interest is calculated p.a. (follows official rules at all times) Does not apply in case of lack of credit, then freight together with expenses and fees are due immediately).


10. Time of validity

The agreement applies from the offer date or specified time phase and until further notice unless otherwise expressly agreed. The agreement is regulated annually on the basis of changes in the Consumer Price Index unless otherwise agreed.


11. Termination

Mutual 1 month, unless otherwise agreed
